How to Handle Pesky Collectors...
and Keep Your Head Above Water.
Debt collectors are tough people to deal with; this is why you must get any tips possible on how to work with them. The following are some of those tips. There are certain things that debt collectors can do, but there are also things that they must not, and you need to know this. This will help make sure that you do not get taken advantage of during the debt process.
Know that a debt collector is allowed to contact you in person. This can be done by email, letter, phone, or fax. They must not try to contact you by telephone during the early hours in the morning or late at night. There are certain time periods when they are allowed to call. This is done to stop them from bullying you. You can also have the right to get an attorney in on this process to make sure that everything is handled correctly. If this is the case then the collectors must not contact you, they must contact the attorney. This is the only third party member that collectors are often allowed to contact. Its nice to know you're not going to be bugged every five seconds working on your debt relief settlements.
Once the collectors contact you they then have five days in order to deliver you a written notice. This notice will tell you who you owe money and how much that amount is. If you do not believe that you owe money they also need to provide you with a way for you to dispute a claim. If they do indeed find that you do not owe money, then a collector is not permitted to contact you within 30 days. Although, if at any time you are sent proof that you do owe money, a collector is allowed to start contacting you once again about collection.
Debt collectors cannot tell you that they represent the government. They are also not allowed to tell you that they are attorneys. Know that you have not committed any crime, so anytime the collector tells you this they are lying. They cannot state that you will be arrested if you do not pay off debt in a quick fashion. They cannot use bullying tactics and empty threats in order to get money out of you. There are certain protections that you have in this entire process to stop debt collectors who will try to pull anything.
Collectors must not state that you owe a certain amount of money you do not. It must always be the exact amount of money. This must be correct down to the penny. All documents from debt collectors must be official documents. They cannot hand you documents that are false and try to pass them off as official. The most important thing that you must not let creditors do is play any games with your credit score or credit. It is not in their right to mess with your credit by trying to get bad marks put on your report when they should not be there. They must not try to pass off false credit information to anyone as well. This also includes credit bureaus.
